The organization of advertising actions is promoted by Baloncesto Málaga SAD, with registered office at Avda. Gregorio Diego, 44 (Málaga) and CIF number A29575933. Baloncesto Málaga SAD plans to hold contests through social networks within the national Spanish territory.
I. Contest Mechanics
The organized contests may request their followers, adhering to the specific conditions of each social network, to share the posts on their walls or profiles, indicate that they like the post, answer questionnaires, post photos, and others to participate in these contests.
In the specific case where it is indicated that the winner will be chosen by a jury, it will be formed by personnel from Baloncesto Málaga SAD, and the selection of the winner will be based on originality, relevance to the theme, image quality, message conveyed… or any other criterion designated by the jury.
The photos and resources used by users to participate may be used by Baloncesto Málaga SAD for dissemination activities, internal use reports, or other activities, provided that express consent of the interested parties is obtained.
In case of force majeure, the contest may be modified, canceled, postponed, or repeated.
II. Free Character
The contest is free.
III. Participation Requirements
Those individuals whose data is incorrect or illegible may not participate.
Baloncesto Málaga SAD reserves the right to eliminate any participant who defrauds or disrupts the proper functioning of this contest.
Participation in the contest is prohibited for all individuals professionally or occupationally linked to Baloncesto Málaga SAD.
IV. Notification of Winners
The promotion organizer must specify the date and manner in which the winner will be notified through the same channel where the contest was announced.
The decision cannot be contested.
The organizer will publish the list of winners on the respective social network and will mention the winner to contact the organizer within 24 hours. If the winner has not contacted the organizer after 24 hours, the prize will be awarded to the first substitute who will have an additional 24 hours to contact the organizer.
V. Prizes
The winner reserves the right to decline the prize, but it cannot be exchanged for a different one or for its cash value under any circumstances. Likewise, the received prize cannot be commercialized and/or sold.
VI. Exoneration of Liability for Network Malfunction
Baloncesto Málaga SAD is exempt from all liability in case of network malfunctions that prevent the contest from taking place due to causes beyond the company and especially due to malicious acts by third parties. Baloncesto Málaga SAD is not liable for any damages that may occur during the enjoyment of the Prize.
VII. Assignment of Winner’s Image and/or Intellectual Property Rights
Participation in the contest implies the explicit assignment and authorization of all intellectual property and image rights on the submissions, so the participant assigns to Baloncesto Málaga SAD the exploitation rights of an intellectual and/or image nature that may correspond to or derive from the submitted entries. The organizer may make the winner and/or substitutes public. Specifically, the winners and substitutes must agree that their username and public profile picture from the different social networks will be published on the organizer’s profiles or other websites to announce the winners of the promotion. Likewise, they will provide their authorization for this purpose.
VIII. Posts or Comments
If participants are required to make comments during promotional events, comments that are considered inappropriate, offensive, injurious, discriminatory, or that could violate the rights of third parties are not allowed. Such publications will be deleted, and participants who include these types of comments will be disqualified.
IX. Disqualifications and Penalties
Baloncesto Málaga SAD may deactivate or disqualify users who violate the promotion rules, and may even penalize participants who have acted fraudulently (creating and/or using multiple accounts to vote for themselves, non-personal profiles, promoting their own participation…).
The specific rules established on each social network will be followed.
The winner may not participate in a new contest until one (1) month has passed.
X. Organizer’s Exoneration of Liability in Case of Participant Noncompliance
Baloncesto Málaga SAD is not responsible for a participant’s failure to comply with the legal bases or for any misuse the participant may make of the received prize.
XI. Protection of Personal Data
In accordance with current regulations on Personal Data Protection, we inform you that the entity responsible for processing your personal data is Baloncesto Málaga SAD with NIF A29575933 and registered office at Avda. Gregorio Diego, 44, C.P. 29004 Málaga, and that your data will be processed for the purpose of participating in ticket giveaways, as well as for sending information about events that may be of interest to you. Participants can contact the organizer through social networks.
XIII. Acceptance of the Rules
Participation in a specific promotional action implies full and unconditional acceptance of these general rules and the specific conditions of each promotional action. Stating non-acceptance of all or part of the rules will result in the exclusion of the participant, and as a result, Baloncesto Málaga SAD will be released from the obligation contracted with said participant.
XIV. Prize Collection
When the contest format and conditions allow it, the prize will be delivered via email. If electronic delivery is not possible, the prize must be collected at the offices of Baloncesto Málaga SAD at Avda. Gregorio Diego, 44, 29004 (Málaga). The winner may authorize a third party to collect the prize, for which they must provide their personal data to Baloncesto Málaga SAD in advance
The parties will mutually determine the most satisfactory way to deliver the prize. Under no circumstances will cash on delivery be accepted.
XV. Jurisdiction and Applicable Law
Promotional actions are governed by Spanish law. Baloncesto Málaga SAD and the participants in the promotion, expressly waiving any other jurisdiction, submit to the courts and tribunals of the participant’s domicile in the promotion for any disputes that may arise from it.
