The full council of Torremolinos approves the ordinance preventing the construction of homes smaller than 37m²
The aim is to minimize the proliferation of new substandard housing, following the annulment of the 2020 PGOU that regulated this aspect
Torremolinos, March 27, 2025.- Today, the full council of the Municipal Corporation of Torremolinos has definitively approved the ordinance on minimum surfaces, minimum stays, and distribution of the dependencies of homes in the municipality, with the vote against PSOE and the abstention of IU-Podemos, and resolution of appeals submitted.
The purpose of this municipal ordinance is to establish a minimum surface of 37.5m², and thus minimize the proliferation of new substandard housing, following the annulment of the 2020 PGOU that also regulated this aspect.
The report has been presented by the Urban Regeneration Councilor, Marina Vázquez, who explained that the appeals submitted by third parties that directly affect the transitional provision referring to retroactivity are accepted, and therefore it is repealed, and this municipal ordinance is definitively approved.
“We have decided to accept them in order not to condemn to a hypothetical and eternal wait in a judicial procedure, and secondly, to balance the public interest of the regulation and the rights of those affected who have submitted appeals, so that the ordinance is definitively approved and comes into effect as soon as possible,” declared Vázquez.
“In this way, we ensure that the interests of all those affected are duly considered and that disproportionate or unfair burdens are not imposed on citizens from a private perspective. But also, from a perspective of the general interest, since by acting in this way, we ensure that homes lacking the minimum requirements for dignified habitation are not created,” concluded the councilor.
