The Public Prosecutor’s Office in Malaga has decreed the closure of the complaint filed by the Socialist Municipal Group regarding a sewage spill in Rio Real due to the DANA rains in a resolution stating that there are no indications of environmental crime or any connection to the Marbella City Council. This was announced today by the Legal Advisory Councillor, María Francisca Caracuel, who pointed out that «this is the latest judicial setback for the PSOE in Marbella, which has used a circumstance arising from an exceptional meteorological event to try to accuse the mayor, Ángeles Muñoz, and others of a crime punishable under the Penal Code and which could have serious consequences.» The Public Prosecutor’s decree states that «if it concerns connections between the Ojén City Council and the Wastewater Treatment Plant, it is presumed that the maintenance of these connections should be the responsibility of the Ojén City Council and not Marbella’s.»
«It seems that the Ojén City Council was not of much interest to the Socialist Municipal Group when filing the complaint,» Caracuel pointed out, lamenting that the Socialists «have been engaging in a politics that cannot be considered political, but rather bad faith, for a long time, based on going to court to find a three-day headline to discredit the Government team and, especially, the mayor.» The councillor explained that the City Council «was informed of these proceedings a few days ago, when it was notified by the Registry of the signing of the closure decree,» specifying that «the complaint originated on November 13, when we were on red alert due to heavy rains and the sewage flowing from Ojén to the La Víbora Wastewater Treatment Plant could not be absorbed by the collectors and ended up spilling into Rio Real.»
She also highlighted that «the prosecutor has been very clear, stating that there is no evidence of environmental crime or any other criminal offense,» and noted that the document also argues that the lack of inspection chambers «is not proven, and it is also not understood how this fact could be attributed to the damages caused by the DANA.» Furthermore, it is emphasized that the entity denounced should not be the Marbella City Council «because it concerns connections between the Ojén City Council and the Wastewater Treatment Plant, and therefore, it would be their responsibility.»
Caracuel also drew attention to the fact that the decree «asserts that the Public Prosecutor’s Office cannot become a supervisory body for the administration, which is what the PSOE has tried to do by seeking a crime where there is none,» and added that the Socialist party in Marbella «has a historical track record of filing complaints that end up being dismissed, as happened with boundary disputes or the General Urban Development Plan, because they do not have a consolidated team, program, or anything to offer to the citizens.» Finally, she affirmed that «the Government team will not be influenced and will continue to work as before, managing and seeking solutions to the needs of the residents.»
